Arvind Kejriwal Gets Bail or not: Delhi Chief Minister Arvind Kejriwal has been granted bail by the Delhi High Court in connection with the alleged liquor policy violation case. A three-hour hearing was held in the Supreme Court on whether to grant interim bail to Arvind Kejriwal. From Abhishek Manu Singhvi for Arvind Kejriwal to SG Tushar Mehta and ASG Raju for ED, arguments lasted for 3 hours, but in the end, the Supreme Court had to reserve its decision. Initially, it seemed that the Supreme Court would grant interim bail to Arvind Kejriwal, but as soon as SG Tushar Mehta presented arguments, it seemed that the puzzle was stuck. However, the Supreme Court is likely to hear the matter on Thursday.

Arvind Kejriwal's case was heard in the Supreme Court for a total of 3 hours. Abhishek Manu Singhvi and Tushar Mehta argued for each other. Justice Sanjiv Khanna's remarks were even objected to by Tushar Mehta. Tushar Mehta opposed in the full court Justice Khanna's remarks that he is the Chief Minister of Delhi and it is election time and it is an abnormal situation. Tushar Mehta had argued that Arvind Kejriwal should be treated like a common man.

Arvind Kejriwal's Hearing

The Supreme Court on Tuesday said it does not want Delhi Chief Minister Arvind Kejriwal to discharge his official duties if he is released on interim bail in a money laundering case linked to the Delhi excise policy scam as it would lead to conflict of interest. However, Arvind Kejriwal did not get any relief from the Supreme Court and the two-judge bench did not pass any order on granting him interim bail to campaign in the Lok Sabha elections. It is pertinent to mention here that Arvind Kejriwal was arrested in this case on March 21 and is lodged in Tihar Jail under judicial custody.

While hearing Kejriwal's plea, a bench of Justices Sanjiv Khanna and Dipankar Datta reserved its order on the question of interim bail, saying allowing Arvind Kejriwal to continue in office can have a "cascading effect." The bench told senior advocate Abhishek Singhvi, appearing for Arvind Kejriwal, "Suppose we grant you interim bail on account of elections. Then if you say you will discharge your official duties, it can have a cascading effect.’

Justice Khanna told Arvind Kejriwal, "If we grant you interim bail, we don't want you to perform official duties as it will lead to conflict of interest somewhere. We don't want your interference in the functioning of the government at all.’ Abhishek Manu Singhvi said that Kejriwal will not take any action on the file related to the excise policy. However, he later said that Kejriwal will not sign any official file if released on interim bail, provided the Lt Governor of Delhi does not set aside the decisions just because the file does not bear his signature.

"Had he cooperated with the investigation, he would not have been arrested. Mehta said Kejriwal would not have been arrested if he had cooperated with the probe, but he defied the nine summons. He said the impression is being created with great success that Arvind Kejriwal has done nothing, but he has been arrested just before the elections.

ED kept these points in Court

During the hearing of the case, the ED told the court that Arvind Kejriwal stayed at the 7-star Grand Hyatt hotel during the 2022 Goa Assembly elections and the hotel bill was paid by Chanpreet Singh. Chanpreet Singh is alleged to have received funds for campaigning for the Aam Aadmi Party in the Goa elections.

Additional Solicitor General SV Raju, appearing for the ED, opposed Kejriwal's interim bail, saying "it is not a politically motivated case." We are not concerned about the politics going on in this case, but our concern is about the evidence. Initially, our focus was not on Arvind Kejriwal, nor was the ED contemplating action against him, but as the investigation progressed, Kejriwal's role became clear.'
