  • Formerly known as the Government of National Capital Territory of Delhi (Amendment) Bill 2023, Delhi Services Bill says that the transfers, inquiries and suspensions of the officers of the National Capital will come under the umbrella of the central government.
  • In addition to this, the Lieutenant Governor will have special powers to exercise his control on matters recommended by National Capital Civil Services Authority and also he will have the authority to summon and dissolve Delhi Legislative Assembly.
  • The Bill passed overrules the judgement passed by the Supreme Court which gave authority to the Delhi government on issues relating to the services of the officers serving in the national capital.

Delhi Chief Minister, Chief Secretary of Delhi and Principal Home Secretary of Delhi will be the members of the National Capital Civil Services Authority. (NCCSA)  The latter two will be the officers of the central government.

Amidst lots of chaos and uproar, Delhi Ordinance Bill in Rajya Sabha has now been passed and the Central Government’s arguments in favour of the Bill are to give powers to the LG in transfer, appointments and suspensions of DANICS and Group A officers in NCR. This will ensure better and uncorrupted practices in the government offices. The Centre says that the Bill is for the maintenance of administrative and democratic balance in governance.

Delhi Services Ordinance Bill 2023

Delhi Ordinance Bill in Rajya Sabha has been passed on Monday 07.08.23 with the support of 131 MPs.  Given the fact that the Centre will now have control over Delhi’s bureaucrats, it was evident that passing this Bill will invite criticism from the Opposition.

  • Aam Aadmi Party which is in power in Delhi took a dig at the ruling party in the Centre by saying that Delhi Services Bill passed in Rajya Sabha will cripple the Delhi government of its powers and will sideline the government which will be elected to power in Delhi.
  • Delhi CM Arvind Kejriwal said that the Delhi Services Ordinance Bill which has won the support of 131 MPs is an insult to the right of the people to vote because it will enslave the people of Delhi. He further said that the Centre is trying to misuse its power and make a mockery of the entire system.
  • Aam Aadmi Party’s Raghav Chadha said that it was one of the moves of the Central Government to take hold of Delhi which they couldn’t win after consecutive elections.
  • Congress Veteran P. Chidambaram too was heard speaking against Delhi Ordinance Bill in Rajya Sabha because he too is of the opinion that it is one of the vested interests of the Central government to take a back-door entry into the Capital.
  • Other Opposition leaders said that this move can best be termed a skilling of democracy and shall be remembered as a black-day.

  • Delhi government will no longer have any say in the appointment, transfer and suspension of Group A and DANICS officers because it will now be done by Lieutenant Governor. (LG)
  • LG will have the power to question the officers falling in the said categories.
  • Though Delhi Government will have the right to appeal against the LG’s decision, the final word will be that of the LG.

Undoubtedly yes. Delhi Ordinance Bill Rajya Sabha voting with a majority will ultimately change the power dynamics in Delhi. Since Delhi Government and LG now stand at opposing ends, the administration will now be trickier and tougher than before. Rest, we have to wait for the time to tell.
